Domestic Preference Compliance

A unique aspect of doing business with the Department of Defense is the need to comply with numerous domestic preference requirements covering procurements of food, textiles, specialty metals and other materials. When compliance is not possible, our team is experienced at processing Domestic Non-Availability Determination (DNAD) requests with the Department of Defense to obtain a waiver for these restrictions. A DNAD is required when a supplier to the Department of Defense is unable to provide 100% domestic textile material under 10 U.S.C. 2533a (the “Berry Amendment”). Similar waiver processes apply to domestic non-availability of specialty metals under 10 U.S.C. 2533b (the “Specialty Metals Clause”). We are skilled in the technical aspects of processing DNAD requests and will assist the client in each step of the process. We simultaneously work with Executive and Legislative branch leaders to address the DNAD request as comprehensively as possible.
